Welcome to Mattley.ai, a DBA of 610er LLC (“we,” “us,” or “our”). By subscribing to or using our services, you agree to be bound by the following Terms of Service (the “Agreement”). Please read these terms carefully before proceeding with any payment.

1. Scope of Services
Mattley.ai provides time tracking, receipts, invoicing, and reporting services (“Services”). Any additional features or customizations outside the standard offerings must be agreed upon separately and may incur additional fees.

2. Payment Terms
Billing Frequency: Payments are billed monthly unless the customer selects an annual plan, which includes a 20% discount.
Payment Methods: Accepted payment methods include credit card, debit card, ACH, and wire transfers via a third-party payment processor.
Recurring Subscription: All plans are automatically enrolled in recurring billing until canceled.
Setup Fees: Setup fees may apply and are non-refundable.
Late Payments: Services will be suspended for any failed or late payments until payment is received.

3. Modifications to Plans
Upgrades/Downgrades: Customers may modify their subscription plans at any time. Changes will be prorated for the remaining billing cycle.
Refunds/Credits: No refunds will be issued for downgrades or cancellations; however, unused balances will be applied as account credits for future billing.

4. Cancellation Policy
Commitment Period: All plans require an initial 6-month commitment unless otherwise noted at the time of purchase.
Notice Period: Cancellations require a 30-day written notice.
Effective Date: Cancellations take effect at the end of the current billing cycle.

5. Usage Terms
Fair Use: Each package specifies the number of invoices included per month. Exceeding this limit will result in overage charges or a required plan upgrade.
Prohibited Use: Customers may not use the platform for illegal activities or upload prohibited content.

6. Customer Data
Ownership: Customer data, including time logs and receipts, is co-owned by Mattley.ai and the customer.
Data Retention: Customer data will be retained indefinitely, even after the account is canceled.

7. Service Availability
Uptime: Services are designed to be available 24/7, contingent on the operational status of the platforms and tools we use to deliver the service.
Disclaimer: Some Services require manual human intervention, and delays may occur. Mattley.ai is not liable for outages or technical issues.

8. Refund Policy
Trial Period: If a free trial is offered, it will apply to a specific package selected by the customer during sign-up. Trial access is limited to the features and usage allowances of the chosen package.
Refunds: No refunds or pro-rated amounts are issued for cancellations or early termination of paid plans.

9. Liability
Disclaimer: Mattley.ai disclaims liability for errors resulting from customer-provided data (e.g., incorrect time logs or receipts), service interruptions, or delays in payment processing by third parties.
Limitation: Under no circumstances shall Mattley.ai be held liable for consequential damages arising from service use.

10. Dispute Resolution
Resolution Process: Disputes will be handled outside of court. If court proceedings become necessary, the customer is liable for any legal fees incurred by Mattley.ai.

11. Legal Compliance
Jurisdiction: This Agreement is governed by the laws of the United States and the state of Colorado.
Compliance: Customers are responsible for ensuring compliance with applicable laws, including GDPR or similar regulations.

12. Termination by Mattley.ai
Mattley.ai reserves the right to suspend or terminate accounts for non-payment, abusive behavior toward staff, or violations of these terms.

13. Support
Standard Support: Email support is included with all plans.
Premium Support: Extended support options may be available for an additional fee.
